Commission of Inquiry on Indian War Crimes in Sri Lanka

India demands Sri Lanka holds a ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-credible investigationƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚. Sri Lanka must oblige India. That investigation must cover two important aspects. Firstly, it must cover IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s role in creating, training, financing and supporting the LTTE as a terrorist movement and IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s war crimes committed on Sri Lankan citizens by the IPKF. Accountability for these massacres by the Indian IPKF needs to be included to the Presidential Commission of Inquiry. If US says the Resolution is an expression of support then the international community must support Sri Lanka to ensure India does not obstruct investigations into crimes by India. This is the conditionality with which the COI should commence under a clearly articulated mandate. ƒÆ’-¡ƒ”š‚ IPKF came to be called the Innocent People Killing Force because they killed civilians! IPKF was sent to Sri Lanka without the consent of the Indian Parliament.
ƒÆ’-¡ƒ”š‚ The scale of crimes committed by Indian troops in Sri Lanka has gone unnoticed. Prabakaran himself said that it was the atrocities committed by the IPKF that contributed towards his decision to kill Rajiv Gandhi in 1991. This corroborates with Former LTTE military commander turned Minister V. Muralitharan or Karuna Amman who claims that the LTTE female cadre who killed Rajiv had been raped by the IPKF. While even the Supreme Court of India in its verdict claimed that the Rajiv assassination was a retaliation for the IPKF atrocities against Tamils in Sri Lanka.
ƒÆ’-¡ƒ”š‚ The background to the arrival of the IPKF is simple. On 26 May 1987, Prabakaran was cornered in Vadamarachchi and would have been caught by the Sri Lankan troops had India not intervened to threaten military intervention if Prabakaran was not released. Thereafter, Prabakaran was flown by Indian plane to India and to show India meant business, India violated Sri LankaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s airspace dropping 25 tons of food in the North. The irony is that while no Sri Lankan has ever to date died of hunger hundreds die in India without food.
ƒÆ’-¡ƒ”š‚ The international community has yet to speak on IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s role in birthing and nursing the LTTE. Part of that blames falls upon Sri LankaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s Government and its failure to set the story straight. The root cause of the conflict is India and unless the Sri Lankan Government is brave enough to say so all these accountability and reconciliation is useless. Reconciliation cannot conceal IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s treacherous role to destabilizing and take over Sri Lanka. Sri Lanka must not shy from telling the world the truth. Indian media pointing fingers from Delhi certainly needs to wake up to this reality and an apology to Sri Lanka is certainly forthcoming.

- Training, arming, financing and functioning as a state sponsor of terrorism in view of its training LTTE on Indian soil using former Indian army personnel and RAW.
- These Indian trained LTTE and other Tamil militant groups have killed scores of Sinhalese, Tamils and Muslims. For every murder, assassination and destruction of property LTTE has committed over 30 years India stands equally culpable. If LTTE stands trial so must India.
- IPKF Indian forces not only killed scores of Sri Lankan Tamils but raped, looted, tortured and took part in indiscriminate shootings. If still our leaders think that India is our friend it’s bullshit. There are certain individuals who sincerly loves Sri Lanka but not these political dynasties who only rule for power and glory. 3 Ghandians were assasinated. They were the sponsors of terrorism. They who created the monsters died from the hands of monsters. India should take the responsiblity for every single citizen of Sri Lanka who died due to L.T.T.E terrorism. Our stupid politicians sometimes think that they have a special personal relationship with the powers that be in India – mostly members of the Gandhi family. This is a false belief for India is not swayed by personal loyalties. When Sirimavo was in power she thought that the Bandaranaike family had a special relationship with the Nehru family – which later became the Gandhi family. Nothing could be further from the truth. India’s policies are always dictated by their Foreign Policy moguls and follow what they perceive as what is best for India’s geopolitical interests.
Therefore it will be foolish for the current Sri Lankan leaders to believe that they can sway India’s stance by the strength of any existing personal relations if any.

Thankyou Shenali -just the words all Sri Lankans should hear! As I have said on a previous comment “Say No to Unilateral accountability”. This is the line we should take – ‘accountability’ for all. The GoSL may have been quite ubderstandably reluctant to take this line in the first instance to avoid being seen as confrontational, but there is no room for such ‘politeness’ any more. Pandering to India’s sensitivities should end now. A report that calls for boycotting West Bank settlement products and states that Israel could be brought before the International Criminal Court for Jewish building over the pre-1967 lines was approved Friday by the United Nations Human Rights Council in Geneva.
Only the United States voted against the report, which was penned by a three-member fact-finding mission.
Speaking before the vote the US said that it was troubled by the council’s biased and disproportionate focus on Israel.
Although the status quo is not sustainable and the US is committed to resolving the Israeli Palestinian conflict, it does not believe that reports such as the one completed by the fact-finding mission can help achieve that objective, the US said.
Israel cut its ties with the council when it formed the fact-finding mission last year.
The report stated that Israel had an obligation under international law not to transfer its population into the Palestinian territories, as it had done by constructing West Bank settlements.
“The Rome Statute establishes the ICC’s jurisdiction over the deportation or transfer, directly or indirectly, by the occupying power of parts of its own population into the territory it occupies, or the deportation or transfer of all or parts of the population of the occupied territory within or outside this territory,” the report stated.
The report explained that settlements violate international human rights laws and International Humanitarian Law.
Private companies that do business with the settlements also bear responsibility not to violate those laws, the report said. It asked them to take “all necessary steps” to ensure that they were respecting human rights, “including by terminating their business interests in the settlements.”
The council also passed another five resolutions against Israeli actions over the pre-1967 lines. These resolutions were filed under Agenda Item 7, which mandates that the council debate Israeli actions in the West Bank, east Jerusalem and the Golan Heights.
The United States, which alongside Israel opposes Agenda Item 7, voted against all the resolutions.
Other resolutions dealt with Israel’s military incursion into Gaza in December 2008 and January 2009, Israeli settlement building and Palestinian human rights including the right to self-determination. All the resolutions had near unanimous support in the council.
The resolution that members appeared to take issue with was one that called on Israel to withdraw from the Golan Heights. It passed by 29 votes, but there were 17 abstentions. Only USA voting against it.
Although the council dealt with human rights issues in Syria, Iran and Myanmar, it adopted more resolutions against Israel than any of those specified countries.

An excellent and a very timely article proclaiming from the hill tops what India is trying to shove under the carpet. ‘The broken palmyrah’, book by a group of Jaffna intellectuals is also an authoritative reference in this regard. I remember what Kumar Ponnambalam wrote in the Newspaper about the IPKF uncivilized and brutal conduct in the Jaffna peninsula. He pleaded with the Sri Lanka government to send Sri Lankan troops to Jaffna whom he said were ‘gods’ compared to the Indian animals in army uniform.

I cannot really understand why our foreign policy experts and others don’t realize how India manipulated us at the end of the Ealam War in 2009. They wanted to get rid of the LTTE, for they knew although it was them who initially bank rolled, trained and created the LTTE, in the end it was the Christian West that was controlling the LTTE. It was the Christian West through the Catholic Church who made the LTTE take up arms against the IPKF and thereafter through the ‘good offices’ of the ‘Peace Facilitator Norway’ almost became another state.
India does not want to see the Eelam established in Sri Lanka but are adamant to see Sri Lanka remains destabilized. This is what they are up to and this is what they do with all their neighboring countries – Pakistan, Bangladesh, Nepal etc. India is happy to see Sri Lanka as its own satellite and under their control. Their ploy is to see Sri Lanka charged for war crimes through mechanisms of the UNHCR in the hope that they can manipulate Sri Lanka to do their bidding.
It is timely that Shenali brought out India’s own war crimes in Sri Lanka. Sri Lanka’s only future lies in being assertive and making an independent path for its future with all weather friends and not those who back-stab everytime we look forward to get on with life.

It is time we go on the offensive for we have no reson to be defensive. The more we try to explain our innocence the more cocky they get to squeeze and twist our arm.
We must stop explaining to people who are not interested in hearing what we say but insist on what they say and start investigating war crimes,crimes against humanity and crimes against international law. We must do it in a transparent and a credible way so that no one can escape justice.
We must invetigate our forces who if,there are any,commited crimes,punish them.
We must invetigate LTTE crimes and find the responsible people,expose them and initiate action against them.
We must also invetigate and find those who supported terrorism under cover of foreign diplomats,officials and politicians regardless whether they are Indian,Australian,UK,US,Canadian,French or scandinavian.And expose them.
